<<Meaning of Stamped 46-1, 68-1 & 67-1 on Your Passport>>
Foreigners residing in Republic of Korea are applied under the 'Immigration Act'.
Some of foreigners may get stamped 46-1, 68-1 or 67-1 on their passport when they leave Korea.
You may know the meaning of stamps as below:
For your information, 46-1 is a violation of Paragraph 1 of Article 46 of Immigration Act, 68-1 is a violation of Paragraph 1 of Article 68, and 67-1 is a violation of Article 1 of the same Korea Law.
(1) 67-1 Stamp (Recommendations for Departure):
If a foreigner staying in the Republic of Korea falls under any of the following circumstances, the head of a Regional Immigration Service may recommend the foreigner to voluntarily depart from the Republic of Korea:
-. A person who violates Article 17 or 20 through a minor offense;
-. A person who violates this Act or any order issued under this Act, in respect of whom the Minister of Justice deems it necessary to recommend departure. (Paragraph 1 of Article 67 on Immigration Act)
*This stamp is for which foreigners with minor fines or penalties receive upon departure, which can voluntarily leave Korea as a 'Warning Disposal' but the disadvantage of Re-entry is not significant.
(2) 68-1 Stamp (Departure Order):
The head of a Regional Immigration Service may order a foreigner to depart from the Republic of Korea in any of the following cases:
-. Where the alien is deemed to fall under any subparagraph of Article 46 (1), but intends to depart voluntarily at his/her own expense;
-. Where the alien has received a recommendation for departure under Article 67 (Recommendation Departure), but fails to comply therewith;
-. Where any of his/her permission, etc. has been revoked under Article 89 (Revocation and Change of Various Permission, etc.);
-. Where it is deemed reasonable to take a measure requiring the foreigner to depart from the Republic of Korea after having imposed an administrative fine under Article 100 (1) through (3)(Fines from 500,000 won to 2 million won);
*This is a disposal that is made when there is no minor violation of the law and the cause for departure is reasonable.
If you receive a Departure Order, you have to leave Korea within certain period, and you will usually be subject to Entry Restrictions of 1 (one) to 3 (three) years.
(3) 46-1 Stamp (Persons subject to Deportation):
The head of a Regional Immigration Service may deport any of the following foreigners from the Republic of Korea according to the procedures prescribed in this Chapter:
-. A person who violates Article 7 (Entry of Foreigners);
-. An alien who violates Article 7-2 (Prohibition of False Invitations, etc.) , or an alien who enters the Republic of Korea by such conduct as a false invitation, stipulated in the same Article;
-. A person who has become or is subsequently found to be subject to grounds for prohibition of entry provided for in the sub-paragraphs of Article 11 (1) (Prohibition, etc. of Entry);
-. A person who violates Article 12 (1) (Entry Inspections) or (2), or 12-3 (Bans on Provision of Ships, etc.);
-. A person who violates any of the terms or conditions of permission imposed by the head of the Regional Immigration Service under Article 13 (2) (Conditional Entry Permission);
-. A person who lands without obtaining permission required under Article 14 (1) (Landing Permission for Crew Members), 14-2 (1) (Landing Permission for Tourism) , 15 (1) (Emergency Landing Permission) , 16 (1) (Landing Permission in Distress) or 16-2 (1) (Temporary Landing Permission for Refugees);
-. A person who violates any of the terms or conditions of permission imposed by the head of the Regional Immigration Service or an immigration control official under Article 14 (3) (including cases to which the aforesaid provision shall apply mutatis mutandis pursuant to Article 14-2 (3)), 15 (2), 16 (2) or 16-2 (2);
-. A person who violates Article 17 (1) or (2) (Stay and Scope of Activities of Foreigners), 18 (Restrictions on Employment of Aliens), 20 (Activities not Covered by Status of Stay), 23 (Granting Status of Stay), 24 (Permission to Change Status of Stay) or 25(Permission to Extend Period of Stay) ;
-. A person who changes or adds his/her workplace without obtaining permission, in violation of the main sentence of Article 21 (1) (Change and Addition of Workplace), or a person who employs an alien or arranges the employment of an alien, in violation of paragraph (2) of the same Article;
-. A person who violates a restriction on his/her residence or the scope of activities, or other matters to be observed prescribed by the Minister of Justice under Article 22 (Restrictions on Scope of Activities);
-. An alien who violates Article 26 (Prohibition of Submission, etc. of False Documents);
-. A person who attempts to depart from the Republic of Korea, in violation of Article 28 (1) or (2) (Departure Inspections);
-. A person who violates the obligation to file for alien registration under Article 31 (Registration of Aliens);
-. A person who violates Article 33-2 (Prohibition against Use of Alien Registration Certificates, etc. as Means to Secure Fulfillment of Debt Obligation, etc.);
-. A person released after having been sentenced to imprisonment without labor or heavier punishment;
-. Any other person specified by Ordinance of the Ministry of Justice, equivalent to one of persons referred to in sub-paragraphs 1 through 10, 10-2, 11, 12, 12-2, and 13.
*This is the strongest and most FORCEFUL DISPOSAL, and even if a foreigner does not want to, but he or she MUST be forced to leave Korea.
*However, depending on the type of VISAs (Status of Stay) for foreigners, it may be reserved depending on the degree of crime but most of them evicted from Korea and it is difficult to Re-entry Korea subject to the Prohibition of Entry for 1 (one) to 10 (ten) years.
*In addition, if you stay in Korea undocumented (illegally), you shall be fined up to 20 million won, depending on your illegal stay period.
***YOU MUST REMEMBER THAT THE MOST IMPORTANT THING FOR FOREIGNERS STAYING IN KOREA IS TO DO THINGS THAT SUIT YOUR VISA QUALIFICATIONS AND COMPLY WITH ALL KOREAN LAW, INCLUDING THE IMMIGRATION ACT ETC.***

(2) 68-1 (출국명령):
강제성이 동반되어 사실상 추방 절차를 발게 되는 데, 법률 위반이 경미하지 않고 출국 사유가 타당할 때 내려지는 처분입니다.
출국명령을 받으면 해당 기간 내에 출국을 해야 하고, 보통 1년~3년 정도의 입국 규제를 받게 됩니다.
(3) 46-1 (강제추방):
가장 강력하고 강제성이 동반되는 처분으로 외국인이 원하지 않더라도 곧바로 강제적인 출국을 진행하게 됩니다.
다만, 외국인의 비자 종류에 따라, 범죄의 정도에 따라서 유보될 수 도 있지만, 대부분 퇴거를 당하고 재입국도 힘들며, 입국 규제는 1년~10년까지 다양합니다.
또한 불법체류를 하는 경우에는 불법 체류 기간에 따라서 최대 2천 만원의 벌금도 내야 합니다.

Foreigners residing in Republic of Korea are applied under the 'Immigration Act'.
Some of foreigners may get stamped 46-1, 68-1 or 67-1 on their passport when they leave Korea.
You may know the meaning of stamps as below:
For your information, 46-1 is a violation of Paragraph 1 of Article 46 of Immigration Act, 68-1 is a violation of Paragraph 1 of Article 68, and 67-1 is a violation of Article 1 of the same Korea Law.
